By creating an account or otherwise accessing or using HelloAgain (the "Service"), you agree to be bound by these Terms of Use (the "Terms").
HelloAgain provides tools for staying connected with trusted people: check-ins, messaging, voice and video calling, shared memories, and care reminders. The Service is provided "as is" and "as available" and may evolve over time.
HelloAgain is not an emergency, medical, or monitoring service. Alerts notify only the trusted contacts you choose. In an emergency, always contact local emergency services directly.
You retain ownership of the content you create (messages, memories, photos). You grant the Company only the limited license necessary to store, process, and deliver such content to the audience you designate.
The Service is presently made available without charge. Notwithstanding the foregoing, the Company expressly reserves the right, exercisable at its sole and absolute discretion, to introduce, impose, alter, condition, or discontinue fees, subscription plans, usage-based charges, premium tiers, or other monetization mechanisms in respect of all or any portion of the Service, at any time. Upon the introduction of any such fees, continued access to the affected features may be conditioned upon (i) payment of the applicable charges through the designated billing channel, and (ii) acceptance of such supplementary commercial terms as the Company may prescribe from time to time. Except where prohibited by applicable law, all fees, once paid, shall be non-refundable. Nothing contained in these Terms, nor any prior provision of the Service or any feature thereof without charge, shall be construed as an undertaking, representation, or warranty that the Service or any feature thereof shall remain free of charge.
The Company may, at its sole and absolute discretion and without prior individual notice (save where such notice is required by applicable law), amend, vary, supplement, restate, suspend, or replace these Terms and/or the Privacy Policy, in whole or in part, at any time. The operative instrument shall at all times be the version published within the application or at the Company's designated location, as denoted by its "Last updated" date. Your continued access to or use of the Service following the publication of any amendment shall constitute your conclusive and binding acceptance of the instrument as amended. The Company further reserves the right to modify, suspend, limit, or discontinue the Service, or any feature or portion thereof, at any time and without liability to you or any third party.
You may delete your account at any time from Profile > Privacy & Data. The Company may suspend or terminate accounts that violate these Terms.
To the maximum extent permitted by applicable law, the Service is provided without warranties of any kind, whether express, implied, or statutory, including without limitation warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising from or in connection with the use of, or inability to use, the Service, including reliance on alerts or check-in information.
All rights not expressly granted herein are reserved by the Company. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with the Privacy Policy and any supplementary terms published by the Company, constitute the entire agreement between you and the Company with respect to the Service.
